Join McCarthy Tétrault’s National Appellate Litigation Group as we discuss appeals of importance to the Canadian business community during the last quarter. Each session brings you up-to-date on recent appellate developments across Canada. Topics to be discussed this quarter include:

  • Supreme Court of Canada: When does a multiplicity of proceedings amount to an abuse of process?
  • Federal: Federal Court of Appeal clarifies whether and when to bring a judicial review when there is a statutory right of appeal.
  • Atlantic: Which jurisdiction’s law governs non-pecuniary damages in a cross-border tort?
  • Québec: Quebec Court of Appeal reiterates the duty to negotiate in good faith when applying a renewal clause but expresses skepticism about whether it can lead to an order for specific performance rather than damages.
  • West: What is the role of negotiation evidence in interpreting contracts?
