The impact of debarment regimes in public procurement cartel investigations: a comparative perspective

Various rules to disqualify corporations found guilty of certain offences from government contracts have been adopted in Canada in recent years, both at the federal and provincial levels. These “debarment regimes” create disincentives for corporations involved in government contracts to resolve criminal cartel and bid-rigging investigations under the Competition Bureau’s Leniency Program.  

Our speakers, a senior Competition Bureau representative and experienced antitrust defense counsel, will discuss the relevant U.S. and Canadian debarment regimes, including the current process to update the Government of Canada’s Integrity Regime. They will also provide a comparative perspective on the impact of these rules on public procurement cartel investigations.
