Scott’s experience as a former architect enables him to anticipate potential risks for the clients he works with on all aspects of their projects.
Scott is a partner in the Business Law Group in Toronto and leads the National Construction Group. He is an experienced construction lawyer qualified in Ontario, Texas, England and Wales, and Australia. His extensive global experience includes advising on some of the largest and most complex infrastructure and construction projects in the world. He is a Fellow of the Construction Lawyers Society of America, and has been recognized in the International Who’s Who of Construction Lawyers and by Legal 500: Latin America for his knowledge in projects and energy.
Prior to pursuing a legal career, Scott practised as an architect in Australia and Canada. He brings this practical construction industry experience to his legal practice. For instance, with an understanding of the terminology used by engineers and contractors, Scott takes a straightforward approach when writing contracts to make them comprehensible for the clients he works with.
He has in-depth experience on a wide array of projects globally in several industry sectors, including oil and gas, petrochemicals, LNG, road and rail infrastructure, power (nuclear, gas, coal, renewables), mining and metals, shipbuilding and architecture.
Scott helps clients take their projects from conception to reality. Specializing in transactional construction work – largely for owners, sponsors and lenders – Scott advises on projects from pre-contract negotiation through contract administration, dispute avoidance and post-contract dispute resolution. In the past few years, he has advised on projects with an aggregate value approaching US$200 billion. He has drafted and advised on all types of purpose-drafted and standard-form construction contracts, including EPC, EPCM, convertible lump sum, design/build and construct-only contracts, and a wide variety of consultancy, supply, O&M and related procurement documents under numerous project delivery models, including P3.
He co-authored the book FIDIC Contracts: Law and Practice (Informa, 2009), on the leading suite of international construction contracts.
Scott received his Bachelor of Environmental Studies from the University of Manitoba, Bachelor of Architecture (Honours 1) from the University of Newcastle in Australia and Bachelor of Legal Studies from Macquarie University in Australia.
