Council of Canadians with Disabilities and the Canadian Association of the Deaf's case reaffirming the rights of Deaf people

Date

March 12, 2026

Office Involved

On March 12, 2026, the Council of Canadians with Disabilities and the Canadian Association of the Deaf appeared before the Canadian Human Rights Tribunal (CHRT) with a case called Lidkea v. Correctional Service of Canada. The case challenges the historical and ongoing failure by Correctional Service of Canada (CSC) to reasonably accommodate Deaf people in the federal correctional system. The CHRT agreed with our submissions that significant systemic remedies are required to address this historical and ongoing failure. The CHRT ordered groundbreaking systemic remedies for all Deaf people in the federal correctional system across Canada.

McCarthy Tétrault assisted the Council of Canadians with Disabilities and the Canadian Association of the Deaf with a team led by Connor Bildfell that included Daniel Siracusa (Litigation).
