Jean-Philippe has extensive experience in complex civil and commercial litigation matters. His practical and creative approach helps our clients obtain successful results.

Jean-Philippe is a partner in our Litigation Group in Montréal since January 2022. His practice is focussed on corporate litigation, contractual litigation, banking law, construction law, class actions, consumer law, insurance litigation, professional liability and constitutional litigation. He has advised and represented clients in a wide range of sectors, mainly in financial services, professional services, telecommunications, technology, transportation (rail, aerospace, automotive and maritime), procurement as well as projects and infrastructure.

Jean-Philippe regularly acts as leading counsel before all trial and appeal courts as well as before various arbitration forums, including the American Arbitration Association and the Canadian Arbitration Association. A seasoned litigator, he has taken part in numerous long-term trials and has extensive experience in Court. In particular, he has successfully led a large number of injunction and safeguard and seizure order files, both for the plaintiffs and the defendants.

Jean-Philippe’s training is bilingual and bijural (civil law and common law).

Corporate Litigation

  • Acted for directors and officers of a public corporation in a major acquisition that was contested by regulatory authorities and some shareholders;
  • Acted for directors and officers of a public corporation in shareholder, employee and retiree claims for misleading representations and alleged wrongdoing;
  • Acted for directors and officers of public corporations in the context of litigation arising from their bankruptcy and corporate restructuring;
  • Acted for directors and officers, shareholders (majority and minority) and companies in multiple oppressive litigation cases;
  • Obtaining and challenging urgent measures to protect shareholder and corporate rights;

Contractual Litigation

  • Acted for aerospace companies in various major contractual litigation cases involving their key suppliers;
  • Acted for telecommunications companies in various commercial disputes involving the companies’ competitors and distributors;

Banking Law

  • Acted for a leading Canadian bank in a class action in relation to its mortgage business practices;
  • Acted for a leading Canadian bank in a case of alleged fraud, frozen accounts and an international clearing system;
  • Acted for a leading Canadian bank in a defamation case relating to the conduct of an internal investigation and before the AMF;
  • Numerous suretyship, line of credit agreement and investment disputes;

Construction Law

  • Acted for a cement manufacturer in an international arbitration matter involving one of its main suppliers, which lasted for several months;
  • Acted for numerous real estate developers, various actors and clients in a litigation case concerning construction defects resulting in environmental contamination;

Class Actions and Consumer Law

  • Acted for directors and officers of a public corporation in shareholder, employee and retiree claims for misrepresentation and alleged wrongdoing;
  • Acted for a telecommunications company in matters of consumer law related to the company’s billing and marketing practices;
  • Acted for a Crown corporation targeted by a $2.4-billion class action related to consumer law;
  • Acted for car dealerships in penal proceedings related to their business practices;

Insurance Litigation

  • Acted for insureds in litigation case against their insurers, insurance wholesalers and insurance brokers;
  • Acted for various corporations, directors and officers to force insurers to grant them insurance coverage, including in the context of an environmental decontamination lasting several decades;

Injunctions and Safeguard Orders

  • Acted for one of the largest Canadian railroad companies in a series of injunctions aiming to prevent a blockade of its operations;
  • Acted for a telecommunications company in various injunction procedures to prevent the broadcast of advertisements;
  • Acted for companies and individuals in Anton Piller and Mareva interim injunction cases;

Professional Liability

  • Acted for and prosecuted many professionals in cases concerning their civil liability;
  • Acted for various companies and professionals in a litigation case involving non-compete and non-solicitation clauses;

Constitutional Litigation and Public Law

  • Acted for a port company in the context of an environmental constitutional litigation case involving the Procureur général du Québec and the Attorney General of Canada, at all stages, from the Superior Court of Québec to the Supreme Court of Canada;
  • Acted for a railroad company in the context of a constitutional litigation case involving the Attorney General of Canada in matters involving human rights;
  • Acted for a telecommunications company in the context of a constitutional litigation case in consumer law involving the Procureur général du Québec;
  • Acted for organizations on a variety of matters before the Commission d’accès à l’information.

Jean-Philippe obtained his Bachelor of Civil Law (LL.B.) from Université de Montréal and was awarded the law faculty medal for the best graduating student. He also obtained a common law degree (J.D.) with honours from Osgoode Hall Law School in Toronto. He was a recipient of The Right Honourable Paul Martin Sr. Scholarship and completed a Master of Law in commercial law (LL.M.) (first class degree) at the University of Cambridge. He also received the Foundation Scholarship from Queens’ College in recognition of his academic achievement.

Jean-Philippe and the Honourable Philippe Bélanger, J.S.C., co-authored the book "Principes et fondements de la responsabilité bancaire à l’égard des tiers," Droit bancaire, Jurisclasseur, 2022. He is also the contributing author of "Defending Class Actions in Canada - A Guide for Defendants", 5th Edition, LexisNexis and of "Loi sur les entreprises par actions du Québec - Analyse et commentaires", Charles Chevrette and Wayne D. Gray, Thomson Reuters, 2022, in addition to writing regularly on McCarthy Tétrault’s various blogs, as well as in the National Insolvency Review.

Jean-Philippe was called to the Quebec Bar in 2014. He is a member of the Young Bar Association of Montréal and the Canadian Bar Association. He sat on the funding committee of Théâtre Jamais Lu for many years and regularly assists the Quebec Cancer Foundation on a pro bono basis. He is also responsible for many initiatives, both within and outside the firm, aiming at promoting mental health.

Since September 2023, Jean-Philippe has served on the board of directors of Arion, a baroque orchestra founded in Montreal in 1981 and a leading figure in early music in Quebec and Canada.
