Egale Canada and Skipping Stone challenge Alberta legislation restricting gender affirming care

On December 7, 2024, Egale Canada ("Egale"), Skipping Stone Scholarship Foundation, and several families in Alberta launched litigation against the government of Alberta challenging the constitutionality of Bill 26, which received Royal Assent on Dec. 5. The legislation will limit access to gender affirming care for transgender and gender diverse young people. The applicants claim that the law unreasonably limits the rights of trans and gender diverse young people in Alberta, contrary to the Canadian Charter of Rights and Freedoms and the Alberta Bill of Rights. 

McCarthy Tétrault is representing the applicants with a team led by Adam Goldenberg and Kara Smyth that included Ljiljana Stanic, Cassidy  Bishop and Javid Dharas (Litigation).
