Recent cases of interest include:

  • Pertman v Grandin Park Properties Inc. – The Alberta Court of Appeal held that an implied easement of apparent accommodation cannot exist when an express written agreement arose at the same time, for the same land, for the same rights, and from the same instruments. This is the first pronouncement from a Canadian court on this issue.
