On February 2, 2022, McCarthy Tétrault successfully represented affected parties in an appeal concerning the distribution of assets from family trusts.
This appeal arose out of a liability trial dealing with alleged breaches of fiduciary duty and subsequent proceedings dealing with the scope of a disgorgement order. The main issue at trial was whether the defendants, trustees of several separate family trusts, breached their fiduciary duties to the plaintiffs/beneficiaries of one such trust by winding up the trusts and distributing the trusts’ assets while in an alleged conflict of interest.
