McCarthy Tétrault represented Advocates for the Rule of Law ("ARL"), as intervenor, before the Supreme Court of Canada (“SCC”) in Canadian Council for Refugees v. Canada (Minister of Citizenship and Immigration), which was heard on October 6, 2022. The appeal concerns the basic requirements of a Charter challenge, the interpretation of the Charter, and the constitutionality of Canada’s Safe Third Country Agreement regime.
