Mélanie Poisson is a partner in our Litigation Group in Montréal.

Her practice focuses on medical liability, commercial litigation, class actions and construction law.

Mélanie appears before courts of first instance, courts of appeal, administrative tribunals and quasi-judicial bodies. In the field of medical liability, she has dealt with civil and disciplinary matters related to complaints filed with healthcare institutions and the Collège des médecins du Québec.

Mélanie began her practice in 2001 in Montréal with a world-class private firm. She joined McCarthy Tétrault in 2017 as a partner.

Mélanie obtained her bachelor of civil law degree from the University of Ottawa in 1999. She was called to the Québec Bar in 2001.

REPRESENTATIVE WORK

  • defending the interests of a railway company with regard to various claims, including a motion for a permanent injunction filed by the Attorney General of Canada in order to force the company to paint a bridge in the province of Quebec, and in the context of a claim filed further to repair work on the same bridge;
  • defending the interests of an aeronautics company in several cases involving manufacturer liability and notions of international law;
  • defending the interests of various private sector companies regarding manufacturer liability claims;
  • defending the interests of physicians in medical liability cases involving both civil and disciplinary matters;
  • defending the interests of various pharmaceutical companies with regard to class actions for damages;
  • defending the interests of bodies providing health and social services to Aboriginal peoples, with regard to construction law litigation (construction defects and design flaws for buildings erected on Aboriginal land);
  • defending the interests of a government body regarding claims filed by a general contractor in the context of construction of major transportation infrastructure;
  • defending a consortium regarding a claim for costs of the impact of construction of a power line;
  • defending the interests of an association with regard to a class action further to possible blood contamination during disease screening;
  • defending the interests of a religious association with regard to a class action for damages related to allegations of sexual abuse;
  • advising and defending the interests of a private sector company related to proprietary leases;
  • defending the interests of an accounting firm with regard to a liability claim for errors allegedly made by the firm in the course of a mandate;
  • defending the interests of companies targeted by abusive claims;
  • defending the interests of a record company with regard to a damage claim brought by an author-composer for payment of mechanical royalties;
  • acting for various clients with regard to injunction proceedings and seizures before judgment.
