Jessica Mank is an associate in McCarthy Tétrault LLP’s Toronto Litigation Group and a member of the firm’s Securities Litigation Group and Procurement Group. She maintains a general litigation practice with focuses on areas including securities, shareholder disputes, corporate governance, major construction, infrastructure, procurement and matters of professional liability. 

Jessica has acted for clients before courts of all levels in Ontario, including the Court of Appeal, and the Health Professions Appeal and Review Board.

Jessica’s litigation experience includes:

  • Cineplex v. Cineworld, 2021 ONSC 8016, represented Cineworld in significant M&A litigation concerning termination of $2.8B+ transaction for breaches of ordinary course covenant;
  • Representing a cultural organization in a proxy contest; 
  • Representing a financial services company in a securities regulatory investigation regarding tied selling;
  • Representing a crypto trading platform in a securities regulatory investigation regarding compliance;
  • Representing a cannabis company in a securities class action alleging misleading disclosure;
  • Conducting an internal investigation of a technology company regarding allegations of corporate misconduct, fraud and regulatory non-compliance;
  • Representing government agencies, hospitals and post-secondary institutions in major construction projects and disputes, including regarding public-private partnerships (P3s);
  • Representing companies in industries including technology, power, and gaming in disputes regarding public procurement processes;
  • Representing the Canadian Civil Liberties Association in its landmark challenge to the constitutionality of prolonged solitary confinement in Canadian prisons; and
  • Defending physicians against allegations of professional negligence or misconduct.

Jessica received her JD from the University of Toronto Faculty of Law, where she held executive positions with the Business Law Society; served as a Senior Editor to the Journal of International Law and International Relations; and volunteered with Pro Bono Students Canada and Downtown Legal Services. Jessica also completed an exchange at the Hong Kong University Faculty of Law. 

Prior to law school, Jessica obtained her Bachelor of Arts (Distinction) in Political Science from McGill University.

Jessica was called to the bar in 2019. She is a member of The Advocates’ Society, the Canadian Bar Association, the Ontario Bar Association and the Construction Law Section of the Ontario Bar Association.
