Andrée-Anne Labbé is a partner in the litigation group in Montréal. Her practice primarily focuses on class actions and civil litigation.

Andrée-Anne pleads regularly before the higher courts and administrative tribunals. She has significant experience as lead lawyer on trials and appeals. She has extensive experience in health law, product liability, professional liability and disciplinary law. Her experience includes litigation involving the Consumer Protection Act.

She is recognized by her clients for her efficiency, her exceptional service and her deep understanding of the issues, including scientific issues which regularly arise in the type of mandates she carries out.

Here are some examples of the cases Andrée-Anne has been involved in:

  • Acting for a healthcare company in the first pharmaceutical product liability class action trial in Canada. In that case, the plaintiffs claimed that the pharmaceutical company failed in its duty to warn and was responsible for the psychiatric effects that group members experienced after taking an antibiotic. The action was dismissed by the Superior Court. The Court of Appeal dismissed the plaintiffs’ appeal and the Supreme Court of Canada refused to hear the appeal.
  • Acting for a pharmaceutical company in a class action on behalf of persons with opioid use disorder.
  • Acting for a pharmaceutical company in a class action alleging that an antipsychotic causes impulse-control disorders.
  • Acting for a pharmaceutical company in a class action alleging that ranitidine causes cancer or increased cancer risk.
  • Acting for a pharmaceutical company that obtained a discontinuance before the hearing on an application for authorization to bring a class action in respect of damages allegedly caused by surgical meshes.
  • Acting for a beverage manufacturer and distributor facing a proposed class action seeking compensation for individuals who developed certain cancers after consuming their beverages.
  • Acting for a beverage manufacturer and distributor facing a proposed class action seeking damages for alleged misrepresentations regarding the contents of their beverages, notably under the Consumer Protection Act.
  • Acting for companies in defense of actions brought against them by ex senior management employees (notably the President and CEO and the CFO) who had been dismissed.
  • Acting for a number of members of the Canadian Medical Protective Association (CMPA) in professional liability actions before the Court of Québec, the Superior Court and the Court of Appeal.

Andrée-Anne obtained her bachelor’s degree in law (LL. B.) from Université Laval in 2007 and made the Dean’s List. She was called to the Quebec Bar in 2008.

She is Chair of the executive committee of the Women Lawyers Forum (Québec) of the Canadian Bar Association.

She sits on the board of directors of the Community Social Paediatrics Centre of Verdun, Les Petits Renards.

She has participated in numerous professional development seminars on medico-legal risks offered to physicians and residents.
