As the world seeks to transition to net zero, demand for raw materials required for the energy transition is soaring. This brings with it many opportunities, but also challenges. Among these are challenges related to how resource-rich Governments will seek to regulate investments. In particular, a significant volume of recent investment disputes in the mining sector have related to protectionist steps taken by governments which have interfered with the investments of foreign investors.

Our panel of experts from the legal and mining sector will talk about how mining companies and their investments can attract (and benefit from) investment protection, how investment protection can help mining companies to avoid disputes with governments, and what mining investors can do to protect their investments if a dispute cannot be avoided.

Markus Burgstaller, a partner in the Hogan Lovells international arbitration team based in London, will moderate the discussion with our panelists:

  • Martha Harrison, McCarthy Tétrault LLP: Martha is a partner in the International Trade and Investment Law, and Retail and Consumer Markets Groups, based in Toronto.
  • Scott Macpherson, Hogan Lovells: Scott is a senior associate in the Hogan Lovells international arbitration team, based in London. He focuses on public international law and, in particular, dispute settlement under investment treaties.
  • Alison MacDonald KC, Essex Court Chambers: Alison is a barrister at Essex Court Chambers, based in London. She has an extensive practice in public international law, arbitration, human rights and criminal law, in both domestic and international courts and tribunals.
  • Nils Engelstad, Alamos Gold: Nils is senior vice president and general counsel at Alamos Gold, based in Toronto. Alamos Gold is a Canadian-based gold producer currently operating three mines – two in Canada and one in Mexico – with a strong portfolio of development stage projects.
