Session 3 - Defence Trade Controls – Canada’s Controlled Goods Program and its Interaction with US ITAR

Companies involved in the defence, military, aerospace and related sectors are subject to the stringent requirements of Canada’s Defence Production Act and Controlled Goods Program (CGP). Although designed in part to work in tandem with the US International Traffic in Arms Regulations (ITAR), this domestic security regime also applies to non-ITAR items and raises numerous compliance challenges for Canadian companies and their partners in the United States and abroad.  Led by a CGP Designated Official who also acts as legal counsel to numerous CGP-registered companies, this practical session will focus on the key requirements of the CGP and its recent changes, as well as areas of compliance challenge and risk exposure, including:

  • how CGP interacts with US ITAR and continuing inconsistencies and conflicts, including with human rights and employment law;
  • mandatory disclosure of actual or potential breaches on a timely basis;
  • challenges with employee security screening and ongoing monitoring;
  • related dealings with the Controlled Goods Directorate and other arms of government, including the RCMP, CBSA and the Export Controls Division of Global Affairs Canada.
