Join McCarthy Tétrault’s National Appellate Litigation Group as we discuss appeals of importance to the Canadian business community during the last quarter. Each session brings you up-to-date on recent appellate developments across Canada. Topics to be discussed this quarter include:

  • Supreme Court of Canada: The latest in the law of defamation, as the Supreme Court of Canada affirms the importance of protecting “counter-speech”
  • Federal: The FCA re-sets the standard for computer-implemented inventions, and cautions against granting patents for turning conventional methods into computer programs
  • Ontario/Atlantic: In a split decision, a majority of the Court of Appeal for Ontario holds that there can be no claim for adverse possession of a public park
  • Quebec: Quebec Court of Appeal clarifies defendant communications with class members during the opt-out period
  • Western Canada: The BCCA confirms a stay of the majority of claims in a proposed class proceeding as a result of an arbitration clause in a standard form consumer contract
