McCarthy Tétrault’s Expertise Recognized in Lexpert® Special Edition: Litigation 2021; Lexpert®’s Top 10 Business Decisions
McCarthy Tétrault’s litigation and dispute resolution expertise was once again recognized in the Lexpert® Special Edition: Litigation 2021. The Firm acted on two of Lexpert®'s Top 10 Business Decisions of 2020-2021, and 43 McCarthy Tétrault lawyers from across Canada are listed in the publication as leading litigators. The Top 10 list is a widely-anticipated annual guide to the most impactful court decisions in Canada. The Lexpert® Special Edition: Litigation 2021 publication highlights litigators and arbitration experts who have helped clients achieve the most favourable results across the whole gamut of dispute resolution matters, both inside and outside of the courtroom.
Our Firm represented clients in the following cases in the Top 10, both of which were argued before the Supreme Court of Canada:
Led by a team of Brandon Kain, Adam Goldenberg and Emily Leduc Gagne, McCarthy Tétrault represented the successful appellant, C.M. Callow Inc., in a landmark Supreme Court of Canada decision on good faith and the duty of honest performance in contracts, which also establishes a new approach to comparative law analysis between common law Canada and Québec.
The Firm represented the Canadian Constitution Foundation (the CCF) as intervener before the Supreme Court of Canada. The case decided that corporations are not protected by the right to be free of cruel and unusual treatment or punishment, as guaranteed to persons under section 12 of the Canadian Charter of Rights and Freedoms. The Court also articulated a methodological framework for constitutional interpretation, in line with the CCF’s submissions. Brandon Kain, Adam Goldenberg and Sébastien Cusson represented the CCF before the SCC.
TVA Group Inc. v. Bell Canada, 2021 FCA 153, in which we acted for the Bell respondents, and ESW Capital, LLC (Re), 2021 ONSEC 7, in which we acted for EdgePoint Investment Group Inc., also received honourable mention from Lexpert.
