McCarthy Tétrault partner Neil Finkelstein named one of the Top 25 Most Influential Lawyers in Canada
Toronto, August 2, 2016 — McCarthy Tétrault congratulates Toronto litigation partner Neil Finkelstein on his recognition as one of Canadian Lawyer’s Top 25 Most Influential Lawyers in Canada in the Corporate-Commercial category.
Canadian Lawyer’s decision to include Mr. Finkelstein on this year’s list was, most notably, for his successful representation as lead counsel for the successful appellant Harish Bhasin in the precedent-setting November 2014 Supreme Court of Canada case of Bhasin v. Hrynew. From the award panellists, “Bhasin represents the first time the SCC has recognized a legal duty to perform contractual obligations in good faith, honestly and with regard to the legitimate expectations of other parties. Its impact is undoubted, generating both attention and alarm.” From the voters: “Finkelstein’s helming of one of the most important contract cases in the last 20 years is another feather in the cap of his storied litigation career.”
With more than 30 years of litigation experience, Mr. Finkelstein has significant expertise as lead counsel in prominent commercial cases at the federal and provincial levels. He has a total of 82 appeals in 7 provincial courts of appeal and the Federal Court of Appeal, including 28 appeals in the Supreme Court of Canada, covering the areas of class-action, competition, constitutional, securities and pension law. He is also a frequent lecturer on constitutional law topics, and is an author in the areas of constitutional, administrative and competition law. His publications include Laskin’s Canadian Constitutional Law (5th edition), Constitutional Rights in the Investigative Process and The Laskin Legacy: Essays in Commemoration of Chief Justice Bora Laskin.
