Good Faith in Canadian Contract Law Book Launch
McCarthy Tétrault is pleased to announce the release of Good Faith in Canadian Contract Law, a first-of-its kind text examining the organizing principle of good faith and the cases and history informing its evolution in Canada and abroad.
The book is authored by McCarthy Tétrault’s Brandon Kain, a leading appellate litigator who successfully represented the appellants in the Supreme Court of Canada’s groundbreaking good faith cases of Bhasin v. Hrynew and C.M. Callow Inc. v. Zollinger. In Good Faith in Canadian Contractual Law, Brandon undertakes a systematic review of the organizing principle of good faith and its associated doctrines, analyzing jurisprudence, commentary and legislation from a number of jurisdictions to provide readers with a full picture of how good faith operates throughout the life of a contract.
Designed as a comprehensive guide on the subject for lawyers, judges, scholars, and students, the book covers:
- The history and essential features of the organizing principle of good faith
- Comparative analysis of good faith outside common law Canada
- Good faith in contractual negotiations
- Good faith in contractual formation
- Good faith in performance: relational duties
- Good faith in performance: situational duties
- Good faith in contractual interpretation
- Remedies for conduct contrary to good faith
“Good faith has emerged as a highly important and complex area of contract law,” said Brandon. “The body of jurisprudence is large and growing, and I believe this text is a much-needed resource for members of the legal profession. It endeavours to be both comprehensive and accessible, and should be of interest whether one is looking for practical guidance, or a discussion of legal theory. I hope that this contribution will assist those who grapple with good faith as its role in contract law continues to evolve.”
Good Faith in Canadian Contractual Law is available for purchase from LexisNexis. It is available in hard copy, e-book or on Lexis+, LexisNexis Quicklaw Advance and the LexisNexis Digital Library.
A book launch event will be held on January 22.
