OVERVIEW

On April 28, 2006, the Court of Appeal of Québec overturned a June 2005 decision of the Superior Court of Québec which had granted a safeguard order against the government of Québec and Kruger Inc. further to an application by the Betsiamites First Nation and the Betsiamites Band. The 2005 decision had banned certain forestry activities in an area located on the North Shore of Québec, a territory that is part of lands claimed by the Innus of Betsiamites.

McCarthy Tétrault LLP advised Kruger with a team led by Ann Bigué that included Marc-André Blanchard, Simon Potter, Alexandre-Philippe Avard and Philippe Levasseur.
