LAWYER(S) MENTIONED

Christopher Hubbard
Elder C. Marques

Toronto, August 23, 2013 — McCarthy Tétrault congratulates partners Christopher Hubbard and Elder Marques on their appointments with the American Bar Association’s (ABA) Business and Corporate Litigation Subcommittee on Class and Derivative Actions. In their three-year appointments, Mr. Hubbard will serve as Co-Chair and Mr. Marques will serve as Co-Vice Chair, organizing legal education for ABA members and providing practitioners, judges and corporate counsel with a forum to discuss emerging issues in class actions in the United States and Canada.

The appointment follows Mr. Hubbard and Mr. Marques’ contribution of the "Cross-Border and Multi-Jurisdiction Class Actions — A Canadian Perspective" chapter in the American Bar Association’s Annual Review of Developments in Business and Corporate Litigation in each of the last two years. Along with McCarthy Tétrault litigator Anthony Alexander, Mr. Hubbard and Mr. Marques reviewed and commented on how Canadian courts have applied jurisdictional principles in the class action context, both in assessing whether certification is appropriate and in relation to the enforcement of foreign class action orders. They worked with their colleagues in McCarthy Tétrault’s offices in Montréal and Vancouver to provide a national perspective.

The Business and Corporate Litigation Committee is one of more than 50 practice-specific committees of the ABA’s Business Law section. The group of more than 2,000 members is focused on areas of litigation that affect business enterprises and promotes the establishment of business courts and other effective means of resolving business disputes.

Mr. Hubbard’s corporate/commercial litigation practice includes class actions, mining litigation, product liability and product recalls, insurance, contractual disputes, securities litigation and shareholder disputes. He also acts in medical malpractice and professional liability cases.

Mr. Marques’ practice includes complex corporate and commercial disputes, class actions, securities litigation and shareholder applications, defamation and a broad range of professional liability cases.

McCarthy Tétrault’s Class Actions Group is an integrated team whose multijurisdictional approach allows the firm to offer a seamless, coordinated service — not only in different cities and provinces, but also internationally and across various areas of legal practice and industry-specific expertise. In addition to its class action litigators, McCarthy Tétrault has leading practitioners in fields as diverse as securities, M&A, consumer protection, corporate finance, financial services, environmental law, products liability, pharmaceuticals, tax, construction, natural resources, intellectual property, administrative law, labour, criminal and real estate law. The firm’s strong working relationships with leading US law firms allows the Class Actions Group to work alongside US counsel on US-originating proceedings, and likewise on international proceedings.

The American Bar Association is one of the world’s largest voluntary professional organizations, with nearly 400,000 members and more than 3,500 entities. Further information about the Business and Corporate Litigation Committee can be found on the ABA’s website, at http://apps.americanbar.org.
