Biography

Tristan Musgrave is a partner in McCarthy Tétrault LLP’s Real Property, Project Development and Infrastructure Group in Toronto. He has a broad based commercial real estate and business law transactional practice with an emphasis on complex infrastructure and development work for both public and private sector clients. In particular, he has extensive experience in public-private partnership (PPP), public procurement, construction and real property acquisition, disposition, financing and commercial leasing matters.

Significant representative transactions include:

  • Advising Infrastructure Ontario and its co-sponsors on real property and commercial transactions (including equity purchase and sale transactions), dispute resolution matters, and the following PPP projects:
    • the Centre for Addiction and Mental Health Phase 1C DBFM Project
    • the New Toronto Courthouse DBFM Project
    • the Pan/Parapan Am Games Athletes’ Village DBF Project
  • Advising Metrolinx and its stakeholders on the PPP development of bus rapid transit facilities in the Region of York north of Toronto
  • Advising Halton Healthcare Services Corporation with respect to the development and operation of its hospital and medical office facilities in Oakville and Milton
  • Advising Whitecastle New Urban Fund, L.P., Diamond Corp. and Build Toronto Inc. in respect of the acquisition, disposition and development of properties in Toronto
  • Advising Cityzen Development Group on a multi-phased condominium development project in Toronto
  • Advising The Corporation of Massey Hall and Roy Thomson Hall with respect to the redevelopment of Massey Hall in Toronto
  • Advised Wilfrid Laurier University in respect of the acquisition and development of properties in Ontario
  • Advised Infrastructure Ontario and its co-sponsors on the following PPP projects:

    • Milton District Hospital DBFM Project
    • Seneca College King Campus Expansion DBF Project

  • Advised University Health Network on the redevelopment of one of its hospital facilities in Toronto
  • Advised Fairmont Hotels and Resorts in respect of the disposition of properties, including the sale of the Fairmont Newfoundland Hotel
  • Developed a template Project Agreement for Infrastructure Ontario for design, finance, operation and maintenance (DBFOM) of water and wastewater projects in Ontario
  • Advised HSBC in respect of multiple secured financing facilities
  • Advised Artscape Non-Profit Homes Inc. and Toronto Artscape Inc., on a pro bono basis, on numerous complex real estate, construction, leasing, subleasing, secured financing and general corporate law matters in respect of the development of the Artscape Wychwood Barns in Toronto, a project which received a Gold Lexpert Zenith Pro Bono Award

Mr. Musgrave received his BA (Hons.) in Economics from Queen’s University in 2001, his MA in Economics from Queen’s University in 2002 and his BCL/LLB from McGill University in 2005. He was called to the Ontario bar in 2007.

Mr. Musgrave is a member of the Law Society of Upper Canada, the Ontario Bar Association and the Canadian Bar Association.
