W. Niels Ortved

Niels Ortved is a counsel in the Litigation Group in Toronto. His practice focuses primarily on commercial, medical malpractice, administrative and criminal litigation. From 1997 to 2002, he served as the firm's managing partner.
Mr. Ortved has appeared as counsel on a full range of litigation matters before all levels of the courts, boards and tribunals, including the Supreme Court of Canada. He has lectured and written articles in the areas of advocacy, civil litigation and criminal law. Mr. Ortved served as a part-time faculty member of the Faculty of Law of the University of Toronto from 1980 to 1987, ultimately leading the course on Trial Advocacy. He served as an elected bencher of the Law Society of Upper Canada, the governing body of the Ontario legal profession, from 1997 to 2003. He is a Fellow of the American College of Trial Lawyers, and in the period from 2004 through 2006, he served as the Ontario Provincial Chair.
Mr. Ortved acted as counsel to the Metropolitan Toronto Review of Citizen Police Complaint Procedure in 1975. He was subsequently appointed by the provincial government to act as a panel member of rotating chairs for Boards of Inquiry to adjudicate such complaints. He has appeared in many criminal trials and appeals. In 1982 through 1984, he acted as counsel on behalf of the physicians before the Grange Commission of Inquiry concerning unexplained deaths in the cardiac ward of the Hospital for Sick Children. Mr. Ortved has appeared as counsel on behalf of physicians in numerous trials, appeals and other proceedings concerning alleged medical malpractice. He has served as counsel to the Toronto Stock Exchange in a number of receiverships resulting from insolvencies of brokerage firms.
Mr. Ortved was engaged to defend against a constitutional challenge brought concerning the areas of practice reserved for Chartered Accountants in the province of Ontario and he has also served as counsel to the appeal tribunal for the Institute of Chartered Accountants of Ontario. He was successful in defending the University of Western Ontario in an action concerning ownership of copyright in numerous computer software programmes and he successfully defended The Toronto-Dominion Bank in a shareholders' rights case that went up to the Supreme Court of Canada. In 2007-2008 he appeared as counsel before the Goudge Inquiry into Pediatric Forensic Pathology in Ontario.
Mr. Ortved is listed in the current edition of Chambers Canada as a leading individual in the field of litigation (general commercial) in Ontario. He also appears in The Canadian Legal Lexpert Directory, a guide to leading law firms and practitioners in Canada, as a leading lawyer in the areas of professional liability, corporate/commercial litigation and medical negligence. Mr. Ortved is recognized in Best Lawyers in Canada as a leading practitioner in corporate and commercial litigation, personal injury litigation, administrative and public law and director and officer liability law.
Mr. Ortved received his BA in 1968 and his LLB in 1971, both from the University of Toronto. He was called to the Ontario bar in 1973.
