Kendra Levasseur is an associate in our Intellectual Property Litigation group in Toronto. Kendra’s practice focuses on complex intellectual property disputes, with an emphasis on patent litigation and copyright disputes. She has represented large pharmaceutical, oil and gas, and technology companies in complex patent infringement and impeachment actions and has appeared before the Federal Court and Federal Court of Appeal in those actions. Kendra’s experience in copyright disputes includes work for major Canadian telecommunications companies and international recording artists. Beyond intellectual property, Kendra has been active in Federal Court proceedings involving questions of administrative law and regulatory matters.

Highlights of Kendra’s patent litigation work include representing:

  • Regeneron and Bayer in three ongoing patent litigation proceedings relating to their blockbuster biologic EYLEA (aflibercept).
  • Farmers Edge in a patent infringement action relating to its FarmCommand farm data platform and CanPlug IoT device (under reserve).
  • MEG Energy in patent infringement action relating to MEG Energy’s SAGD and eMSAGP operations at its Christina Lake facilities (2021 FC 10; 2022 FCA 118). MEG Energy was awarded over half a million in costs for their successful defence of this action (2021 FC 198).
  • Akebia Therapeutics and Otsuka against Fibrogen in a patent impeachment action relating to the launch of its new product, Vadadustat.
  • Allergan in patent litigation relating to the drug RAPAFLO (silodosin) useful to treat, amongst other things, BPH (2020 FC 1189).
  • Aux Sable in a patent impeachment action relating to a patent owned by JL Energy that allegedly covered the transportation of natural gas in the Alliance Pipeline (2019 FC 581).

Highlights of Kendra’s copyright dispute work include representing:

  • International artists, record labels, and music publishers in copyright infringement disputes.
  • Bell in a high stakes and ongoing copyright action brought by Millennium Productions and a number of other production companies for alleged violations of Canada's Notice & Notice Regime.
  • Bell and other ISPs in their ongoing intervention in the Salna reverse class action about how the Notice & Notice Regime is being used by copyright owners.
  • Interveners in the appeal of the first site-blocking order granted by the Federal Court in Canada (2021 FCA 100).

Kendra also volunteers for Pro Bono Ontario, the Indigenous Human Rights Clinic, and the University of Toronto’s community legal clinic Downtown Legal Services providing pro bono counsel on criminal trials.

Kendra received her joint BCL/LLB from the McGill University Faculty of Law in 2017. While in law school, she served as Editor-in-Chief of the McGill Journal of Law and Health and worked as a research assistant in health and intellectual property law.

Kendra obtained her Bachelor of Science in Neuroscience (Neurophysiology/Neural Computation Stream) with a minor in Biotechnology from McGill University in 2014.

Kendra was called to the Ontario bar in 2019. She is a member of the Law Society of Ontario and the Canadian Bar Association. Kendra is bilingual in English and French.
