Expertise Detail

As one of the first firms in Canada to practise environmental law, we have been at the forefront of environmental law for the past quarter century and have the expertise to navigate the complex provincial, territorial, federal and international laws, regulations and agreements affecting businesses and projects in Canada and internationally.

Our National Environmental, Regulatory & Aboriginal Group advises companies and authorities in planning procedures and on business operations in various sectors including energy, power, nuclear, mining, manufacturing, infrastructure, including rail and port, forestry and hospitality and tourism. This includes:

  • environmental scoping and assessment procedures;
  • drafting of planning authorization;
  • permitting, due diligence and compliance assessments;
  • issues relating to land use, planning and zoning;
  • water, soil and natural resource protection;
  • climate change matters including emissions trading, offsets and carbon pricing;
  • negotiations with interest groups and government agencies;
  • representation of our clients in public hearings and in litigation.

We regularly advise on environmental issues in connection with mergers and acquisitions, joint ventures, leveraged buyouts, privatizations and other restructurings and financings, including project financings, lease financings and real estate financings throughout the world. We have substantial experience addressing investment concerns, drafting environmental agreements and indemnities, as well as representations and warranties.

Developers, lenders and governments regularly call on us for environmental compliance advice on projects. As a leading firm on project development, we consistently counsel on the exploration, development and operation of large and complex infrastructure projects in multiple sectors including power, infrastructure, mining and energy, including natural gas and LNG facility and pipeline projects, and renewable energy sources including wind, solar and hydro.

Our lawyers counsel on environmental matters before they become complex and costly legal problems. With Canada’s leading litigation practice, we have acted for both plaintiffs and defendants in environmental and land use litigation and have represented numerous prominent companies in provincial and federal courts. This includes advice on the permitting of industrial production facilities, remediation of contaminated sites, directors and officers liability, reduction of noise and air emissions, emissions trading, chemical regulations, waste regulations and restrictions on hazardous substances.
