Never has there been more uncertainty about the impact of construction legislation than there is following the coming into force of the Prompt Payment and Construction Lien Act (“PPCLA”) (formerly, the Builders’ Liens Act). The PPCLA is designed to impact the daily operation of construction projects as it relates to payment obligations under those projects. Industry participants (whether proponents, contractors, suppliers, consultants, or lenders) can be the leaders in adopting and implementing practices informed by the PPCLA, or be outmaneuvered by those who are.
